These rules govern the Sway Promoter Contest, a monthly skill contest open to professional event organisers who use Sway. They form a binding agreement between the organiser named below and every entrant. Entering the contest means accepting them in full.
1. Organiser
The contest is organised by Sway SRL, enterprise number BE1037531992, Clos des Colombes 23, 1342 Limelette, Belgium, reachable at [email protected] (the "Organiser").
2. Nature of the operation
The Sway Promoter Contest is a contest of skill (concours). Entries are judged by a jury against the published criteria set out in section 5.
It is not a lottery, a tombola, a prize draw or a game of chance, and no part of the result is decided by chance. No entrant is ever selected at random. If two or more entries cannot be separated on the criteria, the tie is resolved by the subsidiary question described in section 5, and never by a draw.
3. Who can take part
Entry is open to a natural person of at least 18 years of age who, at the moment of entry and again at the closing date:
- holds a Sway account with a confirmed email address;
- owns a promoter page on Sway;
- has published at least one event on that page which sells tickets through Sway ticketing, with at least one publicly available ticket type;
- has a Stripe connected account linked to that page which is able to accept payments;
- is established, according to that Stripe connected account, in one of the countries listed for the edition concerned. For the editions covered by this version, those countries are Belgium and France.
Country of establishment is read from the Stripe connected account, which Stripe has verified. It is not self-declared.
Employees, contractors and officers of Sway SRL, and the members of their households, may not take part.
Each entrant may submit one entry per edition. One entry is also the maximum per Stripe connected account: a promoter who holds several pages enters once.
4. Free participation
Participation in this contest is free. No purchase, no payment and no subscription is required to enter or to win.
The conditions listed in section 3 describe how a promoter uses Sway; they are not a payment to the Organiser. Creating a Sway account, creating a promoter page, publishing an event and enabling Sway ticketing are free of charge. Where a ticket is sold through Sway ticketing, the service fee is paid by the ticket buyer, not by the promoter, and no part of it is a condition of entry or an entry fee.
A Sway subscription is not required. Holding one confers no advantage in the judging.
5. The question, the criteria and the jury
Each edition asks a single question, published on the entry form inside the Sway Backstage interface at the moment the edition opens. The answer is limited to 300 characters.
Each entry is scored by a jury of at least two people appointed by the Organiser from among its staff, against the criteria published with the question. Those criteria are, unless the edition states otherwise:
- Relevance: does the answer address the question asked;
- Concreteness: does it describe something the entrant actually does or plans, rather than a generality;
- Clarity: is it intelligible and self-contained;
- Usefulness to other organisers: would another promoter learn something from it.
The jury's assessment is a matter of skill, and the criteria are applied identically to every entry. The scoring sheet is kept by the Organiser as the internal record of the edition.
Subsidiary question. Every entry form also asks a numerical subsidiary question. Where two or more entries obtain the same score, the prize goes to the entrant whose answer to the subsidiary question is closest to the correct value, and if that is still not decisive, to the entry submitted first. Answering the subsidiary question is mandatory.
6. Dates
Each edition opens and closes on the dates shown on the entry form and on the public contest page. In outline, an edition runs for one calendar month:
| Phase | When |
|---|---|
| Entries open | The first day of the month |
| Entries close | The last day of the month |
| Judging | Within the following seven days |
| Winner announced | Within ten days of closing |
| Prize paid | Within ten working days of the announcement |
All dates and times in these rules, on the entry form and on the public contest page are expressed in Belgian time (Europe/Brussels), the time of the Organiser's registered office, whatever time zone the entrant is reading from. The closing time is displayed with its time zone next to it.
The dates displayed on the entry form for a given edition prevail over this outline.
7. The prize
The prize is €500 (five hundred euro) in cash, one prize per edition.
It is paid by bank transfer through Stripe to the Stripe connected account that made the entrant eligible. No other means of payment is available, and the prize cannot be exchanged, transferred to a third party, or converted into any other benefit.
The prize is paid gross. Any tax, social contribution or declaration due on it in the winner's country is the winner's responsibility, as is any accounting treatment applicable to their business.
If the winner ceases to satisfy any condition of section 3 between the closing date and the payment, or if the transfer is refused by Stripe or by the receiving bank, the Organiser may designate the next-ranked entry instead.
8. Publication of the winner
The Organiser publishes, for each edition, the winner's first name, the name of their promoter page, and their answer, on the Sway website and on the Organiser's social media accounts.
A winner may decline this publication, in whole or in part, by writing to [email protected] before the announcement. Declining publication does not forfeit the prize and does not affect the result in any way.
9. Personal data
The controller is Sway SRL, at the address given in section 1.
| What is processed | Account identifier and email address, promoter page and event identifiers, Stripe connected account identifier and country of establishment, the answer and subsidiary answer, and the IP address and browser user agent recorded at the moment of entry. |
| Why | To run the contest: to verify eligibility, to judge the entries, to detect multiple entries, and to pay the prize. |
| Legal basis | Performance of the contract formed by these rules, which the entrant chose to enter into (Art. 6(1)(b) GDPR); the Organiser's legitimate interest in the integrity of the contest for the fraud-detection data (Art. 6(1)(f)). Publication under section 8 rests on the same contract, and can be declined without consequence. |
| How long | Entries and their verdicts are kept for the duration of the programme and for five years after the edition concerned, for accounting and evidential purposes. The IP address and the browser user agent are erased 90 days after the winner is announced. |
| Rights | Access, rectification, erasure, restriction, portability and objection, exercised at [email protected], and the right to lodge a complaint with the Belgian Data Protection Authority, Rue de la Presse 35, 1000 Brussels. |
The Sway privacy notice applies in full to everything not specific to this contest.
10. Instagram, TikTok and other platforms
This contest is in no way sponsored, endorsed, administered by, or associated with Instagram, Meta Platforms, TikTok, or any other social network on which it may be mentioned. Entrants release those companies in full.
No entry is made on a social network, and nothing done on a social network affects the result. Sharing, reposting, tagging, following or commenting confers no advantage and is never a condition of entry. The only way to enter is the entry form inside the Sway Backstage interface.
11. Applicable law and jurisdiction
These rules are governed by Belgian law. Any dispute which cannot be settled amicably falls within the exclusive jurisdiction of the courts of the judicial district of Walloon Brabant, Belgium.
12. Amendment and cancellation
The Organiser may amend these rules, or postpone, shorten, extend or cancel an edition, where a legal, technical or organisational reason requires it. Any such decision is published on this page and, where an edition is already open, communicated to the entrants of that edition, with its reason.
An amendment never applies retroactively: an edition is judged under the version of these rules in force when it opened, whose reference is shown with the edition. No amendment can deprive an entrant of a prize already announced.
